How do I sell a property in Scotland?

  • This first step to selling your home is to arrange for our experienced Estate Agency Team to carry out a FREE pre-sale valuation to determine the current market value. We will also advise you on any works i.e. redecoration that maybe required prior to marketing to guarantee you the best sale price.

  • When you have instructed us to sell your property we will arrange for a chartered surveyor to visit your home to complete a Home Report. It is a legal requirement in Scotland for a seller to provide a Home Report this is prepared before a property is marketed, however this does not apply to a New Build Property (never lived in). The report is made up of 3 documents 1. a single survey on the property’s condition and value, 2. a report on the property’s energy performance and efficiency and 3. a questionnaire completed by the seller giving other details such as council tax band, service providers and details of any Alterations/additions/extensions that have been carried out under the seller’s ownership.

  • A professional photographer will attend to shoot a movie, take photos and prepare a detailed floor plan.

How do I buy a house or flat in Scotland?

  • Choose a property
  • We help you reach a decision on how much you should offer
  • We submit an offer to the seller’s solicitor
  • If your offer is accepted, our conveyancing team work towards putting the property into your name. 

How will Boyd Legal help me buy a property?

  • Once you have found a property you are interested in, our property team can take you through the Home Report, the Energy Report and the Property Questionnaire to see what condition the property is in, what it is valued at, which Council Tax band it is in and if there are any factoring fees
  • Then we will note interest or submit an offer on your behalf. This is free of charge! Noting interest is the first stage in buying a property as it lets the seller know you are interested and want to be kept advised on any developments with the property. The sellers agent are obliged to let us know when they set the closing date, which is the deadline by which all offers have to be made.
  • We will guide you on when and what to offer. In Scotland, most properties are marketed at “offers over”, which means this price is lower than the actual valuation price so always check the home report for the valuation which has been set by the surveyor. Many different factors can affect the property’s worth and how much a buyer should offer for it. For example, the seller might need to make a quick sale, or may lower the price if the buyer offers to pay in cash. We take all this into account to help you make an offer that is reasonable, and is likely to be accepted. If there is a good price to be had, we will get it!
  • We negotiate an entry date that suits you and if you want the white goods or furniture included in the price
  • After all the terms, have been agreed and signed (known as completing the missives), we do all the necessary legal work, including preparing the disposition (the document that transfers ownership of the property from the seller to the buyer), transferring funds (by getting in touch with the buyer’s lender) and registering the buyer as the new owner of the property (known as settlement)
  • We can also help and your partner draft a Will to ensure your property and other assets will be passed on to the next generation or used for a specific purpose.
