Gas leak

If you smell gas do not switch on any electric appliances and open the windows. Contact the National Gas Emergency Service and they will send an engineer out to investigate. This service is free and they will have an engineer with you as soon as possible no matter what the time day or night.

If your property is badly leaking into another you must try and turn off your water supply (in tenement flats, the water stopcock can often be located out in the main stairwell). If you have a burst pipe or any other event that could be considered an emergency (ie either you or the fabric of the property is at risk) in the first instance call the office -if out of hours, the emergency number is given out when you call.

Water leaking into your property: In the event of a serious leak from an adjoining property, you must make every attempt to contact the householder and ensure that they attend to the leak promptly and switch off the water supply if necessary. If a property is vacant, or the householder is refusing to take action contact Environmental and Consumer Services – they can force entry and turn off the water supply if they deem it necessary to do so.0131 529 3030 Environmental Health.

What is the conveyancing process?

As mentioned above, conveyancing is carried out any time property is bought or sold. It is the legal process for transferring ownership, which is triggered when an offer is accepted and ends when ownership is transferred to the buyer. Briefly, this involves multiple stages, including:

  • Negotiating the terms of the contract, such as whether certain items, such as white goods, will be left in the property, and the date of entry, which is the day the funds will be transferred and the buyer is given the keys;
  • Checking the title deeds and searching the Land Register to ensure that the seller is legally entitled to sell the property;
  • Concluding missives, which are the letters exchanged by the buyer’s and seller’s solicitors that form the contract for the sale;
  • When acting for the buyer, ensuring the purchase funds are in place, either directly from the buyer or the buyer’s mortgage lender, transferring payment to the seller’s solicitor on the date of entry and, after the sale is complete, registering the buyer as the owner in the Land Register;
  • When acting for the seller, ensuring the purchase funds are received, and providing the buyer’s solicitor with the legal documents needed to transfer ownership of the property.

How long does conveyancing take?

As with most legal processes, how long conveyancing takes depends on the particular circumstances. It tends to take several weeks, which is a little longer than the time it is likely to take to get your property on the market and accept an offer. This is because much of conveyancing is spent negotiating and agreeing the details of the contract (the missives). This means disagreements between the buyer and seller are likely to slow the process. Other common reasons for there being a delay include the time it can take for the buyer’s mortgage lender to confirm the offer of the loan, the carrying out of anti-money laundering checks or there being a problem with the seller’s title to the property, such as not owning as much of the land surrounding it as they think they do.

After your property is valued, the next step is to get a Home Report. Everyone selling a property in Scotland must pay for a Home Report before they market their home to prospective buyers. A copy must be available for potential buyers to read.

A Home Report gives potential buyers information that helps them decide if they want to make an offer and how much they think the property is worth.

What is a Home Report?

The Home Report is a professional report prepared by a chartered surveyor which includes:

  • A Single Survey – an assessment of the condition of the home, a valuation and an accessibility audit for people with particular needs.
  • The Energy Report – an assessment of the energy efficiency of the home and its environmental impact. It also includes an Energy Performance Certificate (EPC) and recommends ways to improve energy efficiency.
  • The Property Questionnaire – completed by the seller of the home and contains additional information such as council tax banding and inform you of any alternation that have been made to the property by the current owner if any.
