Why do I need a conveyancing lawyer?
In order to buy or sell property in Scotland, you must go through the conveyancing process, which involves many steps, and multiple parties. It covers stages from negotiating through to transferring the ownership from seller to buyer.
The main stages you can expect to go through when completing the process are:
- Negotiating the terms of the contract. This can involve anything from date of entry or key transfer, to which date the seller will receive payment, as well as covering which items will be left in the property.
- Checking the title deeds and searching the Land Register. This is a process that allows us to ensure that the person selling the property is legally entitled to do so. It is also a process that must be completed at the end of the sale to register the buyer as the owner of the property.
- Ensuring that the funds for the buyer are in place, including funds from a mortgage lender, as well as transferring the payment from the buyer to the seller’s solicitor, and on to the seller.
- Concluding missives. Letters exchanged between the buyer’s and seller’s solicitors, which form the contract used to sell the property.
The process can be complex, and regular contact between negotiating parties must be frequent, in order to make the process run as quickly as possible. At Boyd Legal, we use sophisticated systems to work through the routine paperwork, leaving our Conveyancing Lawyers free to respond to your emails and phone calls. While a property may have been placed on the market and sold in the space of a few weeks, the conveyancing process takes will likely take longer than this, due to the nature of negotiations. This is to ensure that both the buyer and seller come away happy with the terms of the agreement. At Boyd Legal, we can guarantee that our lawyers will work relentlessly to ensure that the process runs as quickly and as smoothly as possible.
